How on earth (at least in the US) can any CW contact be illegal? (of
course, assuming not intentionally causing QRM, etc)

FCC rules specifically allow the use of CW by any operator on any band
or portion of any band that operator has authorizatin to use. What's
different about RS12/13 that dosen't fit the "Any portion of any band
authorized" test?

Obviously I'm missing something from your comment here.
